Terms of Service

1. Acceptance of Terms

By accessing or using Sociably ("the Service", "we", "us"), available at thesociably.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify users of material changes by email or via an in-app notice.

2. Description of Service

Sociably is a personal lending tracker. It allows you to:

  • Record items and money you lend to others
  • Invite borrowers to view and confirm their loans
  • Track return dates, conditions, and repayment history
  • Monitor your lending activity and environmental impact

Sociably is a record-keeping tool, not a financial institution. We do not facilitate, guarantee, or mediate actual loans. The "money loan" feature is strictly an organizational tool to help you track informal arrangements between people who already know each other. Sociably assumes no responsibility for the outcome of any lending arrangement recorded on the platform.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You agree to provide accurate, current, and complete information during registration and to keep it up to date. You must be at least 16 years old to use Sociably.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period, with reasonable prior notice where possible.

4. User Content

You retain ownership of all content you submit to Sociably (item names, photos, contacts, notes, etc.). By submitting content, you grant us a limited, worldwide, non-exclusive license to store, display, and process it solely to provide the Service.

You are solely responsible for the content you submit. You agree not to upload content that is unlawful, harmful, defamatory, or that infringes third-party rights.

5. Contact Data & Invitations

When you add a contact's email address to Sociably to invite a borrower, you confirm that you have a pre-existing personal relationship with that person and their reasonable expectation of receiving such an email. You must not use Sociably to send unsolicited commercial messages.

We use contact emails solely to send loan-related notifications and account invitations. We do not sell or share contact information with third parties for marketing purposes.

6. Pricing & Billing

Sociably is currently free during its early access period. When paid plans are introduced, we will notify users in advance with clear pricing information. Early access users who sign up before the paid launch will be offered a discounted or grandfathered rate as communicated at the time.

If and when paid plans are introduced, subscriptions will automatically renew unless cancelled. You may cancel at any time with no penalty. Refunds are handled on a case-by-case basis — contact us at hello@thesociably.com.

7. Privacy

Your privacy matters to us. We collect only the information necessary to provide the Service (account details, item and loan data, contact emails for invitations). We do not sell your personal data.

Our infrastructure is hosted on Supabase and Vercel, both of which are SOC 2 compliant. Data is stored in the United States.

You may request deletion of your account and associated data at any time by contacting us at hello@thesociably.com. We will process deletion requests within 30 days.

8. Prohibited Uses

You agree not to use Sociably to:

  • Facilitate illegal lending, loan-sharking, or usurious arrangements
  • Harass, threaten, or defraud other users or contacts
  • Scrape, reverse-engineer, or attempt to access our systems without authorization
  • Impersonate any person or entity
  • Use the Service for any commercial lending or financial services business

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

We are not responsible for disputes between lenders and borrowers arising from loans tracked on the platform. Sociably is a record-keeping aid, not a legal or financial advisor.

10. Limitation of Liability

To the fullest extent permitted by law, Sociably and its team shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service — including lost items, unpaid loans, or disputes between parties — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Montreal, Quebec.
